What is the MedCanG?
The Medicinal Cannabis Act (MedCanG) has been in force since April 1, 2024 and regulates medical cannabis in Germany independently: medicinal cannabis was removed from the Narcotics Act and has since been a prescription-only medicine like any other, with its own framework for cultivation, trade and dispensing.
For pharmacies, platforms, producers and brands, this raises the central question: what is actually allowed in MedCanG advertising? The short answer: less than many believe, but more than most are using.
Important: this article is a marketing assessment from practice, not legal advice. A legal review of the individual case is mandatory for every project.
The legal situation: HWG beats wishful thinking
Advertising for medical cannabis is governed not primarily by the MedCanG itself, but by the Pharmaceutical Advertising Act (HWG):
- § 10 HWG: prescription-only medicines may not be advertised to the general public, only to professional circles (doctors, pharmacies, specialist trade).
- Product advertising to patients is off-limits: strain advertising, price advertising and efficacy claims towards end consumers fall into prohibited territory.
- Tightening ahead: draft legislation additionally targets restrictions on telemedicine prescriptions and online dispatch. We covered the development here.
Ignoring the limits risks warnings, fines and, worse, the trust of doctors and patients.
The permitted room: what brands can still do
Between “prohibited product advertising” and “doing nothing” lies a wide field that professional brands work systematically:
1. Professional-circle marketing
Factual information towards doctors, pharmacies and the specialist trade is permitted: professional events, trade media, scientific communication. Here, quality decides perception.
2. Corporate communication instead of product advertising
Corporate PR, teams, processes and factual industry topics can be subject to different rules than specific product advertising. They are not automatically cleared: content, context and possible indirect product references require case-specific review.
3. Education (carefully dosed)
Factual educational content can be useful, but it is not a blanket exemption from the HWG. Editorial independence, audience, product references and claims require review; treatment and efficacy promises do not belong in general communication.
4. SEO & owned media
Whoever is present for search queries around medical cannabis with serious, legally clean content gains visibility without “advertising”. In the HWG environment, search visibility is the most valuable channel of all.
5. Events & professional presence
The industry happens at cannabis trade fairs and conferences (ICBC, Cannabis Europa and others). B2B presence, networking and professional booth concepts are the route to the audience here.
MedCanG vs. recreational cannabis vs. CBD: the distinction
| Field | Framework | Advertising possible? |
|---|---|---|
| Medical cannabis | MedCanG + HWG | No public advertising of prescription products; professional and corporate communication require case-specific review |
| Recreational cannabis | CanG (KCanG) | Far-reaching advertising & sponsoring ban |
| CBD / hemp products | Product category (cosmetics, novel food …) | Fundamentally yes, with category and platform limits |

Practical checklist for MedCanG-compliant marketing
- Clarify the audience: professional circles or the public? Everything depends on this.
- Product out, brand in: run public communication at company level.
- Have every campaign legally reviewed: before going live, not after.
- Build an SEO foundation: serious content, clean structure, technical excellence.
- Show professional presence: trade fairs, conferences, trade media instead of Instagram ads.
- Think long-term: in the medical field, whoever builds trust wins, not whoever is loudest.
Conclusion: MedCanG advertising is precision work
Marketing for medical cannabis requires tight legal guardrails, sensitive audience handling and strong professional accuracy. The opportunity lies not in supposed loopholes, but in trustworthy communication that has been properly reviewed.
